Buganda Road Chief Magistrate’s Court has set February 15, 2019, as the date for ruling on whether the charges against jailed former Makerere University researcher, Dr Stella Nyanzi, are substantive, or defective and should therefore be dismissed.
Dr. Nyanzi appeared before the court in compliance with a directive issued by presiding Magistrate Kamasanyu on 17th/Jan when she refused to appear for mention of her case of cyber harassment and offensive communication against President Yoweri Museveni and his late mother Esteri Kokundeka.
ASP Brenda Habaasa a Prison Warden at Luzira reported to Court that Dr. Stellah Nyanzi had refused to come out of her prison cell to board the Prison Bus, on the instructions of her Lawyer Isaac Ssemakadde who claimed that Nyanzi ‘s Private Medical Doctor, advised her to stay away from the trial, as it might further stress her in light of a miscarriage she allegedly suffered this month.
Magistrate Kamasanyu then adjourned the matter to today giving Dr. Stella Nyanzi another chance to appear, saying she was not only still presumed innocent, but that she was also being ill advised by his Lawyer.
However, Ssemakadde maintains that the charges against his client are defective and he therefore wants court to dismiss the case and declare her free.
