Senior state attorney Nelly Asiiku has withdrawn the application that was seeking to bring new additional evidence against Brain Isiko , a 25 year old student at YMCA Jinja branch, who is facing charges of cyber harassment and offensive communication for stalking Kabarore Woman MP, Sylvia Rwaboogo.
Isiko had been sentenced to 2 years and 9 months in prison by Buganda Road Magistrate Gladys Kamasanyu after confessing his too much love for the MP, Sylvia Rwabwogo. However, this decision was quashed and High Court judge Jane Francis Abodo ordered for his retrial.
When the application came up for hearing today before Justice Abodo, Asiiku instead applied for the file to be sent back to lower court for hearing.
Ramathan Waiswa the lawyer of Isiko also told court that an order cannot be revised for as long as the final decision is not yet out.
Justice Abodo then adjourned the matter to March 25 when she will give her detailed ruling.
