The Jinja Resident District Commissioner, Joseph Eric Sakwa has hit back at a high court ruling to vacate office with a notice of appeal.

On Tuesday, Justice Jeanne Rwakakooko in an electronic hearing dismissed with costs an earlier application filed by Sakwa seeking judicial review of his interdiction.

Justice Rwakakooko explained that under the Public Service Standing Procedures, an interdiction is based on preliminary investigations and an officer on interdiction remains innocent until proven otherwise.

It should be remembered that Sakwa was interdicted on May 4th, 2020 after being jailed on charges of manslaughter, malicious damage, and theft.

Sakwa was accused with two others of causing the death of a businessman, Charles Isanga and theft of his property worth Shillings 500,000 while effecting presidential guidelines on COVID-19.

According to the letter, Sakwa was barred from leaving the country with the explicit Clearance from the Secretary, Office of the president, and subjected to half-pay until the interdiction is lifted, the charges against him dropped.

However, after obtaining bail from the high court, Sakwa challenged his interdiction from the office .

The application filed by Sakwa through his lawyers – Nyote and Co advocates and Alaka & Co advocates sought to revoke the earlier interdiction announced by the office of the Presidency by its Secretary, Hajji Kakande Yunus.

The court ordered an interim injunction blocking the Attorney General and Hajji Yunus Kakande, and their agents against evicting Sakwa from his office and that he continues executing his duties unhindered.

This was ordered pending the hearing of his main application but that lasted till Tuesday when the judge ruled otherwise.

Her judgment meant that Sakwa had to vacate office pending the conclusion of his trial.
